These Photographer Terms and Conditions apply when you create a photographer account, upload photographs, list photo records, or receive earnings through FlightToFrame.com.

1. Your role as a photographer
FlightToFrame allows photographers to upload aircraft and flight-related photographs so customers can search for and buy photo-based products connected to a flight number, date, route or journey.
You are responsible for the photographs and information you upload to the platform.
2. Ownership of your photographs
You keep ownership of your photographs. Uploading an image to FlightToFrame does not transfer copyright ownership to FlightToFrame.
You may continue to use, sell, license, display or remove your own photographs elsewhere, unless you have made a separate written agreement with someone else that says otherwise.
3. Licence you give FlightToFrame
By uploading a photograph, you give FlightToFrame a worldwide, non-exclusive licence to use that photograph for the purpose of operating, promoting and fulfilling the platform.
This includes permission to:
- display the photograph on the website;
- show the photograph in search results, previews and customer-facing listings;
- crop, resize, watermark, optimise or format the photograph for website display;
- use the photograph in FlightToFrame marketing, examples, emails, social media posts, advertising and promotional materials;
- sell customer products using the photograph;
- share the photograph with fulfilment, printing and delivery partners where needed to complete orders;
- use the photograph for customer support, fraud prevention, disputes, refunds, chargebacks and platform administration.
This licence is limited to running, promoting and fulfilling FlightToFrame and related orders. It does not mean FlightToFrame owns your copyright.
4. Requesting image removal
You may request that one of your uploaded images is removed from future sale at any time by contacting us or using any removal tools available in your account.
Removal from future sale does not affect completed sales, orders already placed, customer rights, refunds, replacements, chargebacks, support requests, legal obligations, accounting records, fraud prevention records, or commission already validly earned or adjusted under these Terms.
We may need a reasonable amount of time to process removal requests. We may also retain copies or records where needed for legal, tax, accounting, dispute, fraud prevention or order fulfilment purposes.
5. Your promises when uploading
By uploading a photograph, you confirm that:
- you took the photograph or have full legal rights to upload and commercialise it;
- the photograph does not infringe copyright, trademark, privacy, publicity, contractual, data protection or other rights;
- the photograph was taken lawfully and safely;
- you are allowed to provide the photograph for sale through FlightToFrame;
- you have not uploaded stolen, copied, unauthorised, misleading or misrepresented content;
- the flight number, date, route, speed, height, location and related details you provide are accurate to the best of your knowledge;
- the photograph does not create aviation, security, privacy, safety or reputational concerns.
6. Prohibited uploads
You must not upload content that:
- you do not own or have permission to use;
- was taken illegally, unsafely, or from a restricted/private area without permission;
- misleads customers about the flight, date, aircraft, route or location;
- clearly shows private individuals in a way that breaches privacy or other rights;
- contains offensive, unlawful, harmful, discriminatory, threatening or obscene material;
- contains malware, hidden data or harmful files;
- could create aviation, security, privacy or safety concerns;
- breaches any applicable law, regulation or third-party rights.
7. Image quality and approval
We may review, reject, hide, remove, watermark, crop or limit any image at our discretion. We may do this for legal, safety, quality, technical, commercial, branding, customer experience or reputational reasons.
We do not guarantee that every uploaded image will be approved, displayed, promoted, ranked highly, found in search, or sold.
8. Earnings and commission
Photographer earnings are based on the commission rules shown on the website, dashboard or any separate payment information we provide.
Earnings may be affected by product price, fulfilment costs, payment processing fees, platform commission, taxes, currency conversion, refunds, chargebacks, cancelled orders, fraud checks, Stripe Connect fees or other payment-provider fees.
We may withhold, deduct, reverse or adjust photographer payments where an order is refunded, charged back, cancelled, disputed, fraudulent, incorrectly priced or otherwise invalid.
9. Payouts and Stripe Connect
You may need to complete Stripe Connect or other payment-provider verification before receiving payouts. This may include identity, business, tax, bank or compliance checks.
Payment providers may apply their own terms, fees, verification requirements and payout timings. We are not responsible for delays caused by Stripe, banks, payment processors, incorrect payout details, verification checks or legal compliance requirements.
We may set minimum payout thresholds and payout timings. If you close your account, any valid unpaid balance may be paid according to our payout rules, subject to refunds, chargebacks, fees, deductions, verification and legal requirements.
10. Refunds, chargebacks and customer issues
If a customer receives a refund, replacement, chargeback or order adjustment connected to your image, your commission may be reduced, reversed, delayed or deducted from future earnings.
We may use uploaded images and order records to deal with customer support, refunds, damaged items, delivery issues, payment disputes and legal complaints.
11. Copyright complaints and takedowns
If we receive a copyright, privacy, safety or rights complaint about your image, we may remove or restrict the image while we investigate.
We may ask you for proof that you own or have permission to use the image. If you cannot provide suitable proof, we may remove the image, cancel related listings, withhold earnings, close your account, or take other action we consider appropriate.
12. Account closure
You may request account closure by contacting us. Account closure does not affect orders already placed, completed sales, refunds, chargebacks, customer support, legal obligations, accounting records or any rights and obligations that should reasonably continue after closure.
We may suspend or close your account if we believe you have breached these Terms, uploaded infringing content, provided false information, acted fraudulently, created risk for the platform, or misused the website.
13. No employment or agency relationship
You are not an employee, worker, agent, partner or representative of FlightToFrame. You upload images as an independent contributor and are responsible for your own tax, legal and business obligations.
14. Your responsibility to FlightToFrame
You agree to reimburse and protect FlightToFrame from losses, claims, complaints, chargebacks, damages, legal expenses or liabilities arising from your uploaded photographs, inaccurate information, infringement of rights, unlawful photography, fraud, misuse of the platform, or breach of these Terms.
15. Changes to these Terms
We may update these Photographer Terms from time to time. The latest version will be available on the website. Continued use of your photographer account after changes are published means you accept the updated Terms.
